01. SELLER IDENTIFICATION

The seller is the company Bazinga Agency SRL, a company incorporated under Belgian law, with its registered office located at Avenue Henri de Brouckère, 66 bte 2, 1160 Auderghem (Brussels), Belgium, registered with the Crossroads Bank for Enterprises under number BE0652901159 (hereinafter referred to as "Sobooth.com" or "the Seller").

02. PURPOSE

The purpose of these general terms and conditions of sale (hereinafter "T&Cs") is to define the terms and conditions for the sale of products and services offered by Sobooth.com (hereinafter "the Seller") to any professional or individual buyer (hereinafter "the Buyer").

03. PRODUCTS AND SERVICES

Sobooth.com offers for sale various models of photo booths, as well as all the necessary accessories for their operation (photo paper, inks, etc.). The company also offers training services for using this equipment as well as technical support services.

04. PRICES

Prices for products and services are those in effect at the time the order is placed. They are expressed in euros and are exclusive of VAT.

05. VALUE ADDED TAX (VAT)

The following provisions apply to transactions carried out with taxable entities established in another Member State of the European Union:

  • Reverse Charge: The buyer is responsible for reverse charging the VAT due on transactions carried out in application of VAT code provisions.
  • Supporting Documents: The buyer undertakes to provide the seller with all supporting documents necessary to establish intra-Community VAT declarations, in particular its valid intra-Community VAT number.
  • Invoicing: Invoices issued by the seller do not include VAT, it being understood that the buyer is liable for this tax in their own country.
  • Liability: The seller cannot be held liable for tax consequences related to incorrect application of intra-Community VAT by the buyer.

The seller reserves the right to verify the validity of the buyer's intra-Community VAT number before any delivery.

06. ORDERS

Any order constitutes acceptance of these T&Cs.

07. DELIVERY

  • Delivery Terms: Products are delivered to the address indicated by the Buyer when placing the order. Shipping costs are borne by the Buyer, unless otherwise specified.
  • Delivery Times: Delivery times are given for guidance only and are non-contractual. The Seller undertakes to make best efforts to meet announced deadlines.

08. PAYMENT

Payment is made by bank transfer. Payment for ordered products is made exclusively in advance.

Accepted payment methods are: bank transfer and credit cards.

For orders exceeding €2,000 excl. VAT, only payment by bank transfer will be accepted. The seller reserves the right to modify accepted payment methods for certain products, depending on their value or any other consideration. Bank details required for transfer will be communicated to the customer upon order confirmation.

No order will be delivered until full payment of the invoice has been received by the seller.

The transfer of ownership of products to the customer will only occur upon full collection of the price by the seller.

09. WARRANTY

  • Warranty Duration: All Sobooth.com products benefit from a contractual warranty of one year from delivery date, covering manufacturing defects.
  • Warranty Conditions: The warranty does not cover:
    • Normal product wear and tear
    • Damage caused by misuse, negligence, accident, or unauthorized product modification
    • Consumables (photo paper, ink, etc.)
    • Software issues unrelated to a hardware defect
  • Warranty Claim: In the event of a defect covered by warranty, the Buyer must contact the Seller as soon as possible. After verifying the defect, the Seller will proceed, at its option, to repair or replace the defective product.

10. AFTER-SALES SERVICE (ASS)

  • The seller guarantees product compliance with descriptions and the absence of hidden defects.
  • In case of an issue, the buyer benefits from legal warranties (conformity, hidden defects) and can contact ASS using the details provided.
  • To make an ASS request, the buyer must return the product at their own expense in its original packaging along with the invoice.
  • The seller undertakes to process the request promptly (within the specified period).
  • In case of an issue, the buyer may choose between repair, replacement, or refund of the product.
  • Return shipping costs for a repaired or replaced product are borne by the seller.
  • The warranty does not cover normal wear, misuse, or external damage.

11. SELLER'S LIABILITY

The Seller's liability is limited solely to direct and foreseeable damages resulting from a product lack of conformity. The Seller cannot be held liable for indirect, consequential, or immaterial damages resulting from product use, particularly in cases of:

  • Misuse
  • External damage
  • Lack of training
  • Software-related issues
  • Data loss
  • Commercial loss

12. TRAINING

The Seller offers training in the use of photo booths at an hourly rate of €50 excl. VAT. These trainings are not included in the purchase price of the product and must be booked separately.

13. INTELLECTUAL PROPERTY

All intellectual property rights related to products and services offered by the Seller are reserved.

14. FORCE MAJEURE

The Seller cannot be held liable for any delay or failure to perform its obligations resulting from a force majeure event.

15. TECHNICAL AND SOFTWARE SUPPORT

We provide technical support limited to photo booth software. This support is accessible only by prior appointment, during our office opening hours from 9:30 AM to 4:30 PM and subject to available resources.

Any support request that does not fall within these conditions (notably urgent requests, issues related to hardware or network configuration, or requests made the day before or on the day of an event) will be refused. The hourly support rate is €50 excl. VAT per started hour.

16. APPLICABLE LAW AND DISPUTES

These general terms and conditions of sale are governed by Belgian law. Any dispute relating to the interpretation or execution of these general terms and conditions of sale shall be submitted, at the exclusive choice of the seller, to the competent courts of the judicial district of Brussels.
